Training rights in soccer in Mexico
This work describes who is entitled to receive the training rights, what are the requirements, what are the amounts, the procedure, the body to resolve disputes and the prescription of action in Mexican Soccer.
1- Those who have the right to receive training rights
The clubs of promotion (first A, second and third professional divisions) that contributed to the formation of the footballer between 12 and until the end of the season in which the player turns 21 years of age.
A- Document issued by the Mexican Football Federation in which it is stated that the player was registered with his club as a professional.
B- Registered contract between the club and the player.
C- Certification of the Mexican Football Federation that proves that the player has participated in a minimum of 765 minutes with a professional first division club in official matches.
Payment will be made to the club or clubs where the player has performed at least in a professional tournament of the promotion divisions.
We recall that temporary transfers are also taken into account.
3- Those who do not have the right to receive the training rights
A- If a club unilaterally terminates the contract without just cause.
B- The club that has permanently transferred a professional player to another club in any division.
C- Between first division clubs, except their subsidiaries.
If a player under the age of 21 is participating in the first division, the club or clubs that formed him or her before having played in the first division are entitled to training.
If the player leaves his club during the term of his contract without just cause and without having reached the age of 21, the training fee must be paid to that club.
The amounts to be distributed proportionally are as follows:
[First division A] -100,000 pesos (approx $ 5200 USD)
[Second division] -75,000 pesos (approx $ 4,000 USD)
[Third division] - 50,000 pesos (approx $ 2,600 USD)
Participation for training rights will be paid once in the following terms:
A- The player must play a minimum of 765 minutes in a first division club in an official tournament.
B-The person liable for payment is the club where the player accumulates that number of minutes proportionally to the clubs or club that formed them in the amounts mentioned above.
The claim is submitted to the General Sports Directorate of the Mexican Football Federation.
The DGD then notifies the club of the payment request that must be made within 30 days in full.
The amounts must be deposited with the Mexican Football Federation and it will distribute it among the training club or clubs.
This legislation only applies to Mexican players.
The body to resolve complaints about the Right to Training is the Conciliation and Dispute Resolution Commission.
It is given 6 months after the player completes 765 minutes played in a professional first division club.
REGULATION OF PARTICIPATION BY TRAINING
For the purposes of these Regulations, training is understood to be the theoretical and practical training provided by a Club to a person who decides to dedicate himself to the profession of footballer.
The Club or Clubs of the Promotion Divisions (First “A”, Second and Third Professional Divisions) that have contributed to the soccer training of a player, between 12 and until the end of the Season in which the player meets the 21 years of age, will be entitled to receive a participation in the terms indicated in these Regulations.
The Clubs of the Promotion Divisions, in order to claim the participation for training contained in these Regulations, must meet the following requirements:
3.2.1 In your case, present the official document issued by the Mexican Federation of Association Football, AC (FMF), certifying that the player was registered with your Club as a professional in the Tournaments or Seasons in question .
3.2.2 Present the contract (s) signed by the Club and the player, duly registered with the FMF.
3.2.3 Certification Official issued by the FMF General Sports Directorate, by which it is proved that the Player, for whom the payment of the participation for training is requested, has participated for the first time, in a minimum of 765 minutes, with a Professional First Division Club, in the official matches of the corresponding Tournament or Season.
The right to claim participation for training will be required from the 2008-2009 season, when the professional-quality player participates for the first time with a First Division Professional Club, in the official matches of ( os) Tournament (s) or corresponding Season (s) and accumulate in said Tournament (s) or Season (s), a minimum of 765 minutes.
The payment for training participation will be covered only to the Club (s) where the player has formed and acted in at least one Official Tournament of the Promotion Divisions, provided that the requirements indicated are met. Article 3 of these Regulations. For the purposes of the provisions of this article, temporary transfers will also be taken into account.
There will be no right to receive the participation for training, in the following cases:
6.1 If a Club unilaterally terminates the contract with the player, without just cause.
6.2 The Club that has transferred a professional player, definitively, to another Club of any Division.
6.3 Between Clubs of the First Professional Division, except their subsidiaries.
In the event referred to in subsection 6.2 above, the Club that transferred to the player will not be entitled to receive the participation for training.
In the event that a player under the age of 21 is participating in the Professional First Division, the participation by training will only be reported to the Club or
Clubs that have contributed to its formation, even before having played in the Professional First Division, and comply with the requirements referred to in Articles 3 and 4 of these Regulations.
If a player leaves his Club during the term of his contract without just cause, and without having reached the age of 21, said Club must be covered for the corresponding training participation.
The amounts that will be distributed proportionally, to the Clubs that have contributed to the formation of the player are the following:
First “A”: 100,000 PESOS (approx $ 5200 USD)
Second: 75,000 PESOS (approx $ 4000 USD)
Third: 50,000 PESOS (approx $ 2,600 USD)
Participation for training will be paid once and must be covered in the form and terms indicated below:
It will be covered until the player debuts and participates a minimum of 765 minutes in a Professional First Division Club, in an official Tournament or Season.
The Professional First Division Club in which the player has accumulated the 765 minutes referred to in the immediately preceding paragraph, shall proportionally and according to the corresponding Division, cover the Clubs forming the Promotion Divisions, the amounts to referred to in Article 9 of these Regulations.
The Club of the First Professional Division will cover the training Clubs, the amounts referred to in article 9 of these Regulations, as long as the requirements referred to in articles 3 and 4 of this regulation are met.
The amount to be paid must be paid to the benefit of the Clubs that contributed to the formation of the player, being distributed proportionally according to the Tournaments or Seasons in which said player participated in each Club and Division, in which he satisfactorily fulfilled the requirements of articles 3 and 4.
The Procedure for claiming participation for training must be as follows:
11.1 Once the player in question is registered with a First Division Professional team, and has participated in 765 minutes in a Tournament or Season, the training Club or Clubs must:
11.1.1 Present your claim for participation by training, before the General Sports Directorate, accompanied by the documents that prove that the requirements referred to in article 3 of these Regulations have been met.
11.1.2 Once the claim and the corresponding documents have been received, the Sports General Directorate will validate the information presented by the claimant.
11.1.3 Once the claimant has submitted all the requirements to the Sports General Directorate, it will notify the Club in which the player is registered, the request for payment, so that before thirty days, counted from As of said notification, the training participation is paid in full.
11.1.4 The amounts for participation by training, must be deposited in the Mexican Federation of Association Football, AC, through the General Directorate of Administration and Finance, which once received, will proceed to distribute to each Club the part proportional that corresponds, in accordance with the information provided by the General Sports Directorate.
These Regulations will only apply to Mexican players.
The Clubs that have any disagreement or complaint, regarding the participation by training of players, must submit their claim to the Conciliation and Dispute Resolution Commission, to settle their matter.
If the training Club or Clubs do not file their claim within the 6-month period, counted from the time the player complies with the 765 minutes played with a Club of the Professional First Division, in a Tournament (s) or Season (s) ), they will lose the right to claim participation for training.
These Regulations were approved by the Ordinary Assembly of First Division Professional Clubs of the Mexican Federation of Association Football, AC, in the session dated June 3, 2008 and ratified by the National Council on June 4, 2008, entering valid from the 2008-2009 season.
